COOKIES POLICY
The second section of article 22 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (hereinafter, LSSI-CE), establishes the following:
Service providers may use data storage and retrieval devices on recipients' terminal equipment, provided that they have given their consent after being provided with clear and comprehensive information about their use, particularly about the purposes of data processing, in compliance with current legal regulations on personal data protection.
When technically possible and effective, the recipient's consent to accept data processing may be given through appropriate browser settings or other applications, provided that the recipient must configure it during installation or update through an express action to that effect.
The above will not prevent possible storage or technical access solely for the purpose of transmitting a communication over an electronic communications network or, to the extent strictly necessary, for providing an information society service expressly requested by the recipient.
According to the "Guide on the use of cookies," published by the Spanish Data Protection Agency (hereinafter, AEPD) in 2013, the LSSI-CE applies to any type of file or device that is downloaded to a user's terminal equipment to store data that may be updated and retrieved by the entity responsible for its installation. The cookie is one of those widely used devices, so henceforth, we will generically refer to these devices as cookies.
The following cookies are exempt from the obligations established in article 22.2 of the LSSI-CE:
- Allow only communication between the user's equipment and the network.
- Strictly provide a service expressly requested by the user.
TYPES OF COOKIES ACCORDING TO THEIR PURPOSE
A cookie is a file that is downloaded to your computer when you access certain web pages. Cookies allow a web page, among other things, to store and retrieve information about a user's or their equipment's browsing habits and, depending on the information they contain and how the equipment is used, can be used to recognize the user.
As stated in the AEPD's "Guide on the use of cookies," according to the purpose for which the data obtained through cookies is processed, we can distinguish between:
- Technical cookies: These allow the user to navigate through a web page, platform, or application and use the different options or services available, such as controlling traffic and data communication, identifying the session, accessing restricted access areas, remembering the elements that make up an order, completing the purchase process, requesting registration or participation in an event, using security features while browsing, storing content for video or sound dissemination, or sharing content through social networks.
- Personalization cookies: These allow the user to access the service with some predefined general characteristics based on a series of criteria in the user's terminal, such as language, the type of browser through which they access the service, the regional configuration from where they access the service, etc.
- Analysis cookies: These allow the responsible party to track and analyze the behavior of users of the websites to which they are linked. The information collected through this type of cookie is used to measure the activity of websites, applications, or platforms and to create browsing profiles of the users of these sites, applications, and platforms, with the aim of introducing improvements based on the analysis of the usage data of the service users.
- Advertising cookies: These allow the management, in the most effective way possible, of the advertising spaces that, where appropriate, the editor has included on a web page, application, or platform from which the requested service is provided, based on criteria such as edited content or the frequency at which ads are displayed.
- Behavioral advertising cookies: These allow the management, in the most effective way possible, of the advertising spaces that, where appropriate, the editor has included on a web page, application, or platform from which the requested service is provided. These cookies store information on user behavior obtained through continuous observation of their browsing habits, which allows the development of a specific profile to display advertising based on it.
- Third-party cookies: This company's website may use third-party services that, on behalf of this company, collect information for statistical purposes, site usage by the user, and to provide other services related to website activity and other Internet services.
LEVELS OF INTRUSIVENESS
There are three levels of cookie intrusiveness:
- Level 1: corresponds to internal use cookies essential for providing the service requested by the user.
- Level 2: corresponds to anonymous internal use cookies necessary for content maintenance and navigation, as well as cookies managed by third parties within the framework of services expressly requested by the user on those websites (e.g., social plugins from Facebook or Twitter).
- Level 3: corresponds to cookies managed by third parties within the framework of services not expressly requested by the user, allowing tracking across websites of which the owner of the visited website is not the owner (e.g., graphic advertising management platforms). The specification of this level is accompanied by its owner. The use of level 3 cookies is subject to the prior permission of the user through express confirmation of their acceptance.
DEACTIVATION OF COOKIES
You can deactivate the use of cookies (third-party and own) at any time from your browser or restrict third-party cookies.
You can also delete them whenever you want through your browser settings.
If you are using the browser in private mode, the cookies should automatically delete when you close the browser (depends on your internet browser).
